This is a reference translation. The Japanese version is the authoritative text; if there is any discrepancy between the two, the Japanese version prevails.
These Terms of Service (the "Terms") set out the conditions for using the app "Oshicho — A budget book for oshi-katsu" (the "App") provided by Oshicho (the "operator", "we", or "us"). These Terms form part of your agreement with us for use of the App. You accept them when you first open the App, and by using the App you agree to be bound by them.
Article 1 (What the App Is)
The App is a service for recording and managing spending, budgets, plans, and the like related to oshi-katsu (activities supporting idols, artists, and others).
Article 2 (Eligibility)
- The App is available to persons 13 years of age or older.
- If you are a minor, please use the App with the consent of a guardian (a legal representative such as a person with parental authority).
Article 3 (Accounts)
- You can start using the App without registering an account (anonymously).
- If you continue to use the App anonymously, your data cannot be transferred and cannot be recovered if you delete the App or change devices. To preserve your data, please link an account using an email address or the like.
- Please manage the credentials, such as the email address, used for account linking at your own responsibility.
- You can delete your account at any time from the in-app settings. Deleted data cannot be recovered.
Article 4 (Paid Plans)
- The App may provide some features for a fee (such as a subscription). Prices, what is included, and the subscription period are shown in the App before purchase.
- Payment for paid plans is made through the in-app purchase system provided by Apple or Google. The handling of payment, cancellation, and refunds follows the terms of each store.
- A subscription renews automatically on the same terms unless it is cancelled at least 24 hours before the end of the current period. You are charged for the renewal period within the 24 hours before the current period ends.
- To cancel a subscription, use the subscription management screen provided by your device's OS. Deleting the App or your account does not automatically cancel a subscription.
- If the operator revises the price of a paid plan, it will give advance notice of the revised price and its effective date by means such as in-app display or through the applicable store. Price revisions of a subscription are handled under the terms of each store, and you can avoid the new price by cancelling before it takes effect.
Article 5 (User Content)
- The rights to content such as images and text that a user registers in the App ("User Content") belong to the user.
- You grant the operator a royalty-free license to copy, store, and convert (for example, to generate thumbnails or change file formats) your User Content to the extent necessary to provide, maintain, back up, debug, and improve the App. We do not use User Content beyond that scope.
- When registering User Content, please take care not to infringe the copyrights, portrait rights, or other rights of third parties. The user bears any liability arising from registering images or the like for which permission has not been obtained from the rights holder.
- If a rights holder or the like reports an infringement, the operator may, after reviewing the report, delete the relevant User Content or take other necessary measures. Please send reports to the contact in Article 13.
Article 6 (Prohibited Conduct)
In using the App, users must not engage in the following conduct.
- Conduct that violates laws or public order and morals
- Conduct that infringes the rights of third parties (copyrights, portrait rights, privacy, etc.)
- Conduct that interferes with the operation of the App (unauthorized access, reverse engineering, imposing excessive load, etc.)
- Without the operator's permission, running a business built on the App itself, such as incorporating it into a paid service offered to third parties (creating and managing records of your own activities does not fall under this item, whether or not those activities are commercial)
- Other conduct that the operator reasonably determines to be inappropriate
Article 7 (Suspension of Use)
If a user breaches the preceding Article, the operator may suspend use of all or part of the App or delete that user's account. Except where the matter is urgent, the operator will endeavor to give notice in advance.
Article 8 (Change, Suspension, or Termination of the Service)
- The operator may, based on reasonable needs such as maintaining or improving the quality of the App, maintenance, and legal compliance, change the content of the App, or suspend or terminate its provision.
- When ending provision of the App, the operator will endeavor to give advance notice by means such as in-app announcements.
- When ending provision of a paid plan, the operator will give notice at least 30 days before the end date by means such as in-app announcements. In that case the operator will provide the guidance needed to stop automatic renewal, and any unused portion is handled under the terms of the applicable store.
- The operator's liability for damage incurred by users due to a change, suspension, or termination under this Article is governed by the following Article.
Article 9 (The Operator's Liability and Disclaimers)
- The operator does not warrant the accuracy, completeness, usefulness, or fitness for a particular purpose of the App. Amounts and the like recorded and aggregated in the App are based on the user's input; please make decisions regarding household finances, taxes, and the like at your own responsibility.
- Except in cases of the operator's willful misconduct or gross negligence, the operator's liability for damage incurred by a user due to use or inability to use the App is limited to direct and ordinary damages actually incurred by that user, and the total is capped at the amount that user paid to the operator for the App during the 12 months preceding the event giving rise to the liability, or JPY 3,000, whichever is greater.
- Where damage is caused by the operator's willful misconduct or gross negligence, the limitation in the preceding paragraph does not apply and the operator is liable in accordance with applicable law.
Article 10 (Intellectual Property Rights)
The copyrights, trademark rights, and other intellectual property rights in the App and relating to the App belong to the operator or the rightful rights holders (excluding User Content).
Article 11 (Changes to the Terms)
- The operator may change these Terms under Article 548-4 of the Civil Code of Japan where:
- the change is in the general interest of users; or
- the change does not conflict with the purpose of the agreement and is reasonable in light of the need for the change, the appropriateness of the revised content, and other circumstances relating to the change.
- When making such a change, the operator will determine the revised Terms and the date they take effect, and will give notice by means such as in-app notices before that date.
Article 12 (Governing Law and Jurisdiction)
- These Terms are governed by the laws of Japan.
- If a dispute arises between the operator and a user regarding the App, the court having jurisdiction over the user's address shall be the exclusive agreed court of first instance.
